Forsyth County Superior Court Judge Judson DeRamus Junior dismissed the City’s lawsuit shutting down the Red Rooster Night Club because the city did not follow proper procedure and affirm under oath the claims it made in the lawsuit were true.

The Red Rooster was shut down after Winston-Salem Police Sgt. Howard Plouff was shot and later died outside the club when he responded to a shooting outside the club. The owner later closed the club so it’s unclear what the city will do in terms of trying to refile their case.
